Introduction
Paki Events is a project , operating a web/mobile application, () available on Google Play Store, iOS, and other similar platforms, as well as a website. Together, the App and Website shall be referred to as the “Platform.” These terms and conditions govern the use of or access to the Platform and the Services (as defined below). These Terms constitute a binding and enforceable legal contract between the Company and a User (as defined below) or any end user of the Services (collectively, “you”). By continuing to access or use the Platform, or any Service on the Platform, you signify your acceptance of these Terms. If you do not agree to all of these Terms, please do not access the Platform or use the Services.
Eligibility
You represent and warrant that you:
(a) have full legal capacity and authority to agree and bind yourself to these Terms,
(b) are 18 (eighteen) years of age or older to avail any service where age is a pre-condition,
(c) if you are under 18, have sought adult guidance from your guardian/parent so that you fully understand these terms and conditions.
If you represent an entity, organization, or any other legal person, you confirm that you have the necessary power and authority to bind such entity, organization, or legal person to these Terms. These Terms also include our privacy policy and any internal guidelines, supplementary terms, policies, or disclaimers issued by us from time to time.
Changes to Terms
The Company reserves the right to make changes to these Terms by posting the new/updated version, and your continued use or non-deletion of the Platform shall indicate your agreement to such changes. We encourage you to review the Terms periodically to stay updated with any modifications.
Services
The Company:
- Provides a Platform where users (“Users”) can hire third-party vendors specific to the wedding and events industry, including, but not limited to, photographers, videographers, event managers, caterers, and venue providers (“Services”).
- Offers a feature that allows Users to generate inquiries on the portal, enabling vendors to provide the best quotes instantly. The Company uploads these inquiries from various sources (e.g., Website, social platforms), giving selective vendors access to provide quotes for this feature.
Onboarding
To avail the Services, a User is required to create a profile/sign-up on the Platform (“Profile”) using their email ID and/or phone number, along with other necessary details. Users must ensure that all information provided is accurate and kept updated.
The User is solely responsible for maintaining the security and confidentiality of their username and password. Any unauthorized use or breach must be immediately reported to the Company at (*) in writing. The Company disclaims any liability for unauthorized access to a User’s Profile.
The User agrees to receive communications from the Company regarding:
(i) transactions recorded on the Platform,
(ii) requests for payment,
(iii) information about the Company and Services,
(iv) promotional offers and services from the Company and its third-party partners,
(v) and any other matter related to the Services.
User Responsibilities
The User agrees and represents that all information provided to Paki Events, including information shared by service provider Users in relation to services, is valid, complete, accurate, and truthful as of the date of accepting these Terms. The User acknowledges that Paki Events is not responsible for any loss or damage that may result from incorrect, incomplete, inaccurate, or misleading information provided. Additionally, if any third-party service provider Users provide false information, Paki Events will bear no liability.
Paki Events acts solely as a platform connecting service provider Users with Users seeking services. Paki Events does not accept responsibility for any false or misleading information provided by Users.
The User is solely responsible for ensuring compliance with applicable laws and regulations. The User shall bear full liability for any consequences arising from non-compliance with legal obligations.
The User agrees to extend full cooperation to Paki Events in defending any legal proceedings resulting from breaches of these Terms or obligations.
The User shall not use the services provided by Paki Events in any manner that violates these Terms. Specifically, the User agrees not to:
- Infringe any third-party rights, including copyrights, patents, trademarks, or trade secrets.
- Copy, display, distribute, modify, publish, reproduce, store, transmit, post, translate, or create derivative works from the services except as expressly permitted.
- Transmit or upload any data or materials containing viruses, Trojan horses, or other harmful programs.
- Use automated devices or manual processes to monitor or copy Paki Events or its services.
- Engage in activities that may be harmful, defamatory, obscene, blasphemous, racially or ethnically objectionable, harassing, invasive of privacy, or unlawful.
The User must conduct proper research to ensure that the goods and services they provide are compliant with all applicable laws. Generating payment links for prohibited content may result in account suspension or removal.
Prohibited Services and Products
The User agrees not to use Paki Events services for the sale or supply of prohibited products or services, including but not limited to:
- Sale of regulated goods.
- Sale of counterfeit or pirated goods infringing intellectual property rights.
- Sale of tobacco, cigarettes, liquor, narcotic drugs, or psychotropic substances.
- Activities resulting in non-compliance with applicable laws, including money laundering or gambling.
Third-Party Services
Paki Events may include services, content, and information owned by third parties (“Third Party Services”). Use of Third Party Services is at the User’s own risk. Paki Events is not responsible for the accuracy or completeness of Third Party Services or any liability arising therefrom.
Third-party vendors must ensure the accuracy of information they provide and hold Paki Events harmless for any misuse of images or content uploaded.
Paki Events facilitates payments through third-party Payment Service Providers (PSPs). Users are advised not to share personal bank details, pins, or OTPs. Paki Events and its PSP partners will not be liable for any fraud resulting from the sharing of such details.
Termination
These Terms remain in effect unless terminated according to the provisions hereunder. Paki Events reserves the right to terminate a User’s access immediately if there is a breach of obligations.
Intellectual Property
All rights to the Paki Events platform and its services, including intellectual property, are owned or lawfully licensed. Users are granted a limited license to use the services in accordance with these Terms.
Disclaimers and Warranties
Paki Events provides services “as is” and “as available.” Paki Events disclaims all warranties, express or implied, to the fullest extent permitted by law. Users accept full responsibility for any consequences arising from their use of the services.
Indemnity
The User agrees to indemnify Paki Events against any claims, demands, lawsuits, or liabilities arising from the use of the services.
Consent to Use Data
Paki Events may collect and use User data in accordance with its Privacy Policy for analytical purposes and legal compliance.
Fees/Charges
Services offered on Paki Events are non-transferable and non-refundable. Users must independently maintain transaction records for their reference.
Modification
Paki Events reserves the right to modify or discontinue services without notice.
Jurisdiction and Dispute Resolution
These Terms are governed by Pakistani law. Disputes will be resolved as per the provisions outlined in these Terms.
